The Management of Health and Safety at Work Regulations 1999 requires an employer to undertake a risk assessment of workplace-related stress. The Health and Safety at Work Act 1974 also requires employers to implement control measures.
Failure to conduct this risk assessment or implement control measures can result in prosecution by the enforcement authorities.
Fatal accidents at work or even suicide can also result from unacceptable stress levels, prompting a police investigation and exposing senior management to heavy fines or even imprisonment.
